La compañía afirma que la intención de la Fundación Fronteras Electrónicas de legalizar esta actividad es contraria a la ley.
En una respuesta a la Oficina de Copyright estadounidense, la compañía alega que la liberación de los móviles “es una ataque a las decisiones que Apple pueda tomar con respecto al diseño del iPhone y a la estrategia de distribución de aplicaciones para el iPhone a través de la tienda App Store”.
La EFF considera que los usuarios están en su derecho de desbloquear el terminal móvil a fin de instalar aquellas aplicaciones que les parezca más interesantes sin la obligada aprobación por parte del fabricante.
Apple, que cuenta con el apoyo de la industria multimedia (discográfica y cinematográfica), sigue explicando que en caso de aprobarse la exclusión del desbloqueo de los móviles de la Digital Millenium Copyright Act “se destruiría la cadena de confianza que la compañía elaboro cuidadosamente para proteger a los usuarios de los serios problemas que pueden producirse de las modificaciones no autorizadas del sistema operativo”.
Insiste, además, que facilitaría el ataque de malware a los terminales móviles y podría ocasionar daños al aparato, así como también un incremento de sus costes operativos de soporte técnico al atender a usuarios que modificaron sus dispositivos.
En sus alegaciones, EFF traslada la situación planteada por Apple a la industria automovilística y lo incomprensible que resultaría para los consumidores que estos no pudieran modificar ni instalar en su automóvil piezas no originales o licenciadas por los fabricantes.
