La legislación francesa impide la venta en exclusiva de un producto por parte de un suministrador de servicios.
De acuerdo a las leyes francesas, Orange (la operadora que tiene la exclusiva de la venta del terminal) deberá ofrecer dos versiones distintas del iPhone.
El próximo 29 de noviembre saldrán al mercado el iPhone “Orange” que conllevará una suscripción al servicio de 18 meses y al precio de 399 euros.
Por otra parte también deberá vender el mismo terminal (el de 8GB) en el mercado libre. Por el momento Orange no ha informado cual será el precio de este dispositivo aunque se espera que sea mucho mayor.
La verdad que es curioso que en Estados Unidos con las leyes anti monopolia que hay, aun no haya saltado la liebre y hayan podido obligar a AT&T a vender ellos tambien telefonos libres, pues ademas tambien ganarian dinero ganando una comision por terminal y lo venderia logicamente mas caro que su version con contrato.
En España, desconozco si se puede tener un producto en total exclusiva aunque me parece que si debe ser posible, pero… me gustaria que alguien que lea este articulo y sea abogado, pueda darnos algunas ideas sobre legislacion vigente que podria poner en duda el que el operador que gestionara en nuestro pais Iphone no deba ofrecerlo tambien libre como pasa en Francia.
