Un ciudadano de Illinois, José Trujillo, ha presentado la primera demanda legal en contra de AT&T y Apple por el programa de reemplazamiento de la batería.
Si bien el problema de las baterías ha sido una de las principales críticas desde el lanzamiento de sus reproductores de MP3, iPod, el fenómeno se repitió al iPhone.
De acuerdo con la demanda número 07CH 19744, Apple y AT&T ocultaron de manera fraudulenta a los compradores del teléfono un costo anual de 85.95 dólares por el reemplazo de la batería, por lo que Trujillo solicita por la reparación del daño 75 mil dólares, para cubrir el costo del equipo y los gastos de la representación legal.
En el documento, Trujillo destaca que desconocía el costo adicional, porque este no había sido anunciado previamente.
Explica que el teléfono es una unidad sellada, la batería está soldada al dispositivo, por lo que el cambio sólo lo puede realizar Apple.
El tiempo de vida de la batería es de unas 300 recargas, lo que significaría que anualmente debe reemplazarse si el propietario desea seguir manteniendo el dispositivo en perfectas condiciones.
Trujillo describe en su demanda, que el propietario debe enviar el terminal a Apple para que este reemplace la batería. El coste del envío es de 6.95 dólares y por el repuesto 79 dólares más, lo que significa que el equipo tiene un sobrecoste anual de 86 dólares.
Otro problema, precisa, es que este proceso significa que el consumidor se queda sin un terminal móvil durante tres días aunque Apple le alquila otro igual por ese periodo al coste de 29 dólares.
Todo ello, supone un grave problema para el comprador, ya que además del sobrecoste se ve privado del terminal durante un periodo enfrentándose al riesgo de perder la información almacenada, como contactos, agenda, etc.
