Parece ser que no está todo dicho en la cuestión sobre la marca iPhone. Hasta ahora hemos explicado que esta marca pertenecía a la empresa norteamericana Cisco y que Apple ha lanzado su nuevo y primer teléfono móvil bajo este nombre sin demasiados escrúpulos con respecto a la titularidad del mismo. Pero, como decimos, parece ser que Apple tenía un as en la manga.
La jugada sería la siguiente: según la legislación americana en el registro de patentes, pasados seis años de un registro debe proporcionarse una Declaración de Uso que justifique la utilización de la marca. Cisco registró iPhone en noviembre de 1999 y seis años después todavía no había presentado esta declaración. Una prórroga de seis meses para cumplir este requisito le fue concedida, como es procedente, y Cisco, a dos semanas vista del fin del plazo, entregó la declaración. En la misma figuraba que Cisco había bautizado uno de sus teléfonos, el Linksys CIT2000, con la marca iPhone. Pero en la práctica, según el punto de vista que le interesaría a Apple (y la sensación que para muchos ha dado la aparición de este teléfono) se trataba de una maniobra absurda que consistía en rebautizar un aparato que ya tenía un nombre determinado con el fin de cumplir con las exigencias de la Declaración.
De hecho, en la documentación aportada figuraba una imagen del teléfono donde apenas se había pegado una etiqueta adhesiva con el nombre iPhone. Ciertamente el teléfono se había comercializado a partir de diciembre de 2006 con este apellido añadido, pero incluso en las instrucciones del aparato no aparecía la marca, debido a que se trataba de las instrucciones impresas antiguas.
La conclusión es que Apple podría alegar que Cisco no utilizó la marca iPhone durante el periodo correspondiente a los seis años, más la prórroga, y que por lo tanto el nombre tendría que quedar libre. Sea como sea, Apple debe de estar a la expectativa de lo qué pasará con esta cuestión, aunque desde que se frustraron las negociaciones con Cisco para intentar comprar la marca, la verdad es que no ha tenido demasiados miramientos a la hora de usarla.
